Welcome to Humanity Badge.
These Terms of Service govern your access to and use of the website available at humanitybadge.com, including user accounts, profiles, badges, micro-credentials, community functions and other services made available through the website.
Please read these Terms carefully. By creating an account, accessing or using Humanity Badge, you confirm that you have read, understood and agreed to these Terms.

In these Terms, Humanity Badge sp. z o.o. may be referred to as “Humanity Badge”, “we”, “us” or “our”.

You may write to us at any time regarding your account, the Platform, technical problems, payments, micro-credentials, another user’s conduct or content that may violate these Terms.
Humanity Badge is an online platform intended to support individuals, organisations, professionals, volunteers, mentors and other people interested in social impact, humanitarian action, international development, education and related fields.
Depending on the functions currently available, users may be able to:

Humanity Badge is a free platform.
Creating an account and using the standard functions of the Platform does not require a subscription fee.
The only paid services currently offered through the Platform are selected micro-credentials. A micro-credential is paid only when it is clearly marked as a paid service before the user orders it.
We will not charge you merely for creating an account, maintaining a profile or accessing functions that are presented as free.
Before ordering a paid micro-credential, you will be shown:

You may use the Platform only if you are legally permitted to enter into an agreement under the laws applicable to you.
Users under the age of 18 may use the Platform only where permitted by applicable law and, where required, with the consent of a parent or legal guardian.
When creating an account on behalf of an organisation, you confirm that you are authorised to act on behalf of that organisation.
We may request reasonable information necessary to verify your identity, age, authority to represent an organisation or eligibility for a particular service or micro-credential.
To use certain functions, you may need to create an account.
You agree to:
You may not create an account using another person’s identity or falsely claim to represent another person or organisation.
One person should normally maintain one personal account unless we expressly allow otherwise.
We may refuse or remove usernames, organisation names or profile information that are misleading, unlawful, offensive or infringe third-party rights.
Humanity Badge is intended to be a respectful, inclusive and constructive community.
You must treat other users with dignity and respect, including people whose nationality, culture, language, background, experience, profession or opinions differ from your own.
When using the Platform, you must not:
Disagreement and constructive criticism are permitted. Personal attacks, threats and harassment are not.
Users should communicate professionally, especially when discussing humanitarian work, vulnerable communities, employment, volunteering, education, grants or professional qualifications.
You may not use Humanity Badge to:
You must not attempt to avoid restrictions imposed on your account by creating another account or using another person’s account.
“User Content” means information, text, images, documents, profile descriptions, comments, links, applications, messages and other materials submitted to the Platform by a user.
You retain ownership of your User Content.
By submitting User Content, you give Humanity Badge a non-exclusive, worldwide and royalty-free licence to host, store, reproduce, display, format and technically process that content only to the extent reasonably necessary to:
This licence ends when the content is deleted, except where temporary backup copies remain or retention is required by law, for security purposes or for the establishment, exercise or defence of legal claims.
You confirm that:
You remain responsible for your User Content.
Some information submitted to Humanity Badge may be visible to other users or publicly available on the internet.
Before publishing personal or confidential information, check the available visibility or privacy settings.
Do not publish sensitive personal information that is not necessary for your use of the Platform. This includes identification document numbers, passwords, payment card details, medical records or private information concerning another person.
Information that you intentionally publish on a public profile may be viewed, copied or shared by other internet users. Humanity Badge cannot fully control how third parties use information that you have deliberately made public.
Humanity Badge may offer badges and micro-credentials confirming participation, completion of an activity, verification of information, assessment of skills or achievement of defined criteria.
The detailed requirements for a micro-credential may be presented on its description or order page.
A micro-credential may require:
Humanity Badge may refuse to issue, suspend or revoke a micro-credential where:
Where reasonably possible, we will explain the reason for refusing, suspending or revoking a micro-credential and allow the affected user to request a review.
Unless expressly stated otherwise, Humanity Badge micro-credentials:
A credential may include an expiry date or require renewal. Any such condition will be indicated in its description.
The price of each paid micro-credential will be displayed before purchase.
Payments may be processed by an external payment service provider. The payment provider may apply its own terms and privacy rules.
Where required by law, the displayed price will include applicable taxes or the applicable taxes will be clearly shown before the order is confirmed.
The micro-credential assessment or verification process may begin after payment has been successfully completed.
If payment is cancelled, reversed, disputed or obtained fraudulently, we may suspend the related assessment or credential while the matter is investigated.
Nothing in these Terms limits any mandatory consumer rights available under applicable law.
Where you purchase a paid service as a consumer, you may have a statutory right to withdraw from the contract within 14 days without giving a reason.
Where you ask us to begin providing the paid service before the end of the withdrawal period, we may ask you to:
The specific withdrawal information applicable to a purchase should be displayed during the order process or provided in the purchase confirmation.
The right of withdrawal does not affect your rights where a paid digital service is defective, does not match its description or has not been supplied as agreed.

Humanity Badge may display information about grants, funding programmes, jobs, volunteering, events, educational programmes or other third-party opportunities.
This information is provided for general informational purposes.
Unless expressly stated otherwise, Humanity Badge:
You should verify deadlines, eligibility requirements and official documents directly with the relevant organiser before making decisions or incurring costs.
Information on the Platform does not constitute legal, financial, tax, investment or professional advice.
We may review User Content or account activity where:
Moderation may involve automated tools and human review. Automated tools may be used to identify spam, malware, suspicious login activity, fraudulent behaviour or other security risks.
Depending on the seriousness and frequency of the violation, we may:
We will seek to apply moderation decisions proportionately and consistently.
Where reasonably possible and legally permitted, we will inform the affected user about the action taken and the main reason for the decision.
Immediate action may be taken without prior warning where necessary to protect users, prevent fraud, address serious security risks, comply with law or respond to manifestly illegal or seriously harmful content.

Submitting a report does not guarantee that content will be removed. We will assess reports based on the available information, these Terms and applicable law.
Knowingly submitting false or abusive reports may itself be treated as a violation of these Terms.
Where we remove your content, restrict your account, refuse or revoke a micro-credential, or take another material enforcement action, you may request a review by writing to:
Unless a different period is required by law, the review request should normally be submitted within six months of the decision.

We will consider the request in a timely, fair and non-discriminatory manner and communicate the result to you.
The Platform, its software, design, layout, databases, logos, graphics and original materials are owned by or licensed to Humanity Badge and are protected by intellectual property laws.
Subject to these Terms, Humanity Badge gives you a limited, non-exclusive, non-transferable and revocable right to access and use the Platform for its intended purposes.
You may not, without prior written permission:
You may display a valid Humanity Badge credential issued to you in accordance with any applicable credential or branding guidelines.
The Platform may contain links to third-party websites, services, payment providers, organisations or resources.
Humanity Badge does not control third-party services and is not responsible for their availability, security, content or privacy practices.
A link does not automatically mean that Humanity Badge endorses the third party.
You use third-party services subject to their own terms and at your own discretion.
We process personal data in accordance with applicable data protection law and the Humanity Badge Privacy Policy.

We aim to keep Humanity Badge available and secure, but we do not guarantee uninterrupted or error-free operation.
Access may be temporarily limited because of:

Where a change materially affects users, we will seek to provide reasonable notice, unless urgent action is required for legal, security or technical reasons.
The Platform is provided on an “as available” basis.
To the extent permitted by law, Humanity Badge does not guarantee that:

Nothing in this section limits mandatory consumer rights.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
In particular, these Terms do not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or liability arising under mandatory consumer protection law.
To the extent permitted by law, Humanity Badge is not responsible for:
For users acting for business or professional purposes, our total liability arising from a paid service will not exceed the total amount paid by that user to Humanity Badge for the service giving rise to the claim during the 12 months preceding the event giving rise to liability, unless applicable law requires otherwise.
This limitation does not apply to consumers where it would restrict mandatory statutory rights.
You may stop using Humanity Badge and request closure of your account at any time by contacting:
Account closure may result in the removal or deactivation of your profile and User Content.
Some information may be retained where necessary to:
Closing an account does not automatically invalidate a legitimately issued micro-credential, although its public verification page may be affected depending on the credential’s settings and technical structure.
We may suspend or terminate access where a user:
Where appropriate, we will give advance warning and an opportunity to correct the violation.
Advance warning may not be provided where immediate action is necessary for safety, security, fraud prevention, legal compliance or protection of other users.
We may update these Terms to reflect:

Where a change is significant, we will make reasonable efforts to notify registered users through the Platform, by email or through another appropriate method.
Changes will apply from the effective date stated in the updated Terms.
If you do not agree with an updated version, you may stop using the Platform and close your account.
These Terms are governed by Polish law.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the law of the country in which you normally live.

A consumer may also use any consumer complaint, mediation or alternative dispute resolution procedure available under applicable law.
Disputes involving consumers will be handled by the courts having jurisdiction under applicable consumer and procedural law.
For disputes involving users acting exclusively for business or professional purposes, the courts competent for the registered office of Humanity Badge sp. z o.o. will have jurisdiction, unless mandatory law provides otherwise.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
Our failure to enforce a provision immediately does not mean that we waive the right to enforce it later.
You may not transfer your rights or obligations under these Terms without our prior written consent.
We may transfer our rights and obligations in connection with a merger, restructuring, sale of the Platform or transfer of business, provided that this does not reduce mandatory user or consumer rights.
These Terms, together with the Privacy Policy and any specific conditions displayed for a paid micro-credential, form the agreement between you and Humanity Badge concerning use of the Platform.
